Devotional exercises were conducted by the Reverend Melvin Bridge of Ryegate.

Bill Referred

House bill of the following title was read the first time and referred:

An act relating to the creation of a state law enforcement study committee.

Bill Referred to Committee on Finance

House bill of the following title, appearing on the Calendar for notice, and affecting the revenue of the state, under the rule, was referred to the Committee on Finance:

H. 313.

An act relating to the administration and enforcement of fines within the judicial bureau.

Joint Resolution Adopted on the Part of the Senate

Joint Senate resolution of the following title was offered, read and adopted on the part of the Senate, and is as follows:

     J.R.S. 30.  Joint resolution relating to weekend adjournment.

Resolved by the Senate and House of Representatives:

That when the two Houses adjourn on Friday, April 13, 2007, it be to meet again no later than Tuesday, April 17, 2007.

Joint Resolution Placed on Calendar

J.R.H. 22.

Joint resolution originating in the House of the following title was read the first time and is as follows:

Joint resolution designating Sunday, April 15, 2007 as Generosity Sunday in Vermont.

Whereas, the Network of Spiritual Progressives in Vermont, and around the country, brings people of all paths together to uphold the ethical and moral values common to every faith tradition, and

Whereas, the strength and stature of our nation depend on upholding the values of compassion, generosity, equality, freedom, justice, social responsibility, and the interconnectedness of all life, and

Whereas, a campaign to shift the security paradigm from domination to generosity, understanding, and compassion would be a more effective means to peace, and

Whereas, the key to global security is working with the rest of the world to reduce poverty, hunger, homelessness, and disease, and

Whereas, the Network of Spiritual Progressives proposes a Global Marshall Plan to address these destabilizing problems, similar to the plan that rebuilt the war-torn nations of WWII, and

Whereas, the Vermont Network of Spiritual Progressives in Brattleboro will be hosting Generosity Weekend and Generosity Sunday events on Sunday, April 15, 2007, now therefore be it

Resolved by the Senate and House of Representatives:

That the General Assembly designates April 15, 2007 as Generosity Sunday in Vermont in recognition of the principle that generosity, understanding, and compassion should be the basis for all human interactions, be they commercial, political, or social, or be they personal, local, national, or international, and be it further

Resolved:  That the secretary of state be directed to send a copy of this resolution to the Vermont Network of Spiritual Progressives in Brattleboro.

Thereupon, in the discretion of the President, under Rule 51, the joint resolution was placed on the Calendar for action tomorrow.

House Proposal of Amendment Not Concurred In; Committee of Conference Requested

S. 37.

House proposal of amendment to Senate bill entitled:

An act relating to mosquito control.

Was taken up.

The House proposes to the Senate to amend the bill as follows:

First:  In Sec. 1, 6 V.S.A. § 1085(b), by striking out the words “After approval of an application submitted” where they appear in the first sentence and inserting in lieu thereof the words After submission of an application

Second:  By adding a new section to be numbered Sec. 2a to read as follows:

Sec. 2a.  STATEWIDE POLICY FOR MOSQUITO CONTROL

The agency of agriculture, food, and markets and the department of health shall propose a statewide policy for mosquito control and abatement.  The proposed policy may take the form of draft legislation.  On or before January 15, 2008, the agency of agriculture, food and markets and the department of health shall report to the house and senate committees on agriculture with the proposed statewide policy required by this section.

Thereupon, pending the question, Shall the Senate concur in the House proposal of amendment?, on motion of Senator Kittell, the Senate refused to concur in the House proposal of amendment and requested a Committee of Conference.

An act relating to discharge of a mortgage by an attorney.

Bills Passed in Concurrence

House bills of the following titles were severally read the third time and passed in concurrence:

An act relating to approval of an amendment to the charter of the town of Brattleboro.

H. 254.

An act relating to the transfer of payroll functions from the department of human resources to the department of finance and management.

H. 525.

An act relating to the Vermont fire service training council and the division of fire safety.


Proposal of Amendment; Bill Passed in Concurrence with Proposals of Amendment

H. 334.

House bill entitled:

An act relating to restitution.

Was taken up.

Thereupon, pending third reading of the bill, Senator Campbell moved that the Senate proposal of amendment be amended by adding a new Sec. 10 to read as follows:

Sec. 10.  13 V.S.A. § 6607 is added to read:

§ 6607.  DISCLOSURE OF CONFIDENTIAL RECORDS; NOTICE TO PROSECUTION

When a defendant seeks access to a victim’s school records, or to any other records of a victim which are by law confidential, the defendant shall provide written notice to the prosecutor that the records have been requested prior to the service of any subpoena requesting the records.

Which was agreed to.

Thereupon, the bill was read the third time and passed in concurrence with proposals of amendment.

An act relating to the rendering of nursing and medical services by professional corporations.

H. 510.

An act relating to Vermont Life magazine.

H. 516.

An act relating to the creation of one fund within each of the three Vermont retirement systems and to compliance with federal requirements.


Consideration Postponed

S. 124.

Senate bill entitled:

An act relating to planning and evaluating options for impatient psychiatric hospital services.

Was taken up.

Thereupon, without objection consideration of the bill was postponed until the next legislative day.

Joint Resolution Adopted on the Part of the Senate

J.R.S. 29.

Joint Senate resolution entitled:

Joint resolution supporting the application of the Republic of China (Taiwan) for observe status at the World Health Organization.

Having been placed on the Calendar for action, was taken up and adopted on the part of the Senate.

Rules Suspended; Bills Messaged

On motion of Senator Shumlin, the rules were suspended, and the following bills were ordered messaged to the House forthwith:

H. 372; H. 510.

Adjournment

On motion of Senator Shumlin, the Senate adjourned until eleven o’clock and forty-five minutes in the morning.
