Statement of purpose:  This bill proposes to require the agency of agriculture, food and markets to develop health and safety best practices for farms, proposes a certification program for compliance with the health and safety best practices, requires the department of banking, insurance, securities, and health care administration to track any correlation between certification under the safety program and a reduction in workers’ compensation claims, and proposes to require the agency of agriculture, food and markets to develop best practices for rural and agricultural vocational rehabilitation to be used by vocational rehabilitation counselors.

AN ACT RELATING TO WORKERS’ COMPENSATION IN AGRICULTURE

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  21 V.S.A. § 624(l) is added to read:

(l)(1)  The agency of agriculture, food and markets, in collaboration with the University of Vermont extension service, farm organizations, and other groups serving farm communities shall develop farm safety and occupational health best management practices for the protection of farm workers and shall develop educational programs that will enable farm workers to understand and comply with those best management practices.

(2)  The agency of agriculture, food and markets, in collaboration with the department of labor, the department of banking, insurance, securities, and health care administration, and representatives of the insurance industry shall develop a safety certification program for farms based upon the best management practices developed under subdivision (1) of this subsection.

(3)  The department of banking, insurance, securities, and health care administration shall monitor the number of workers’ compensation claims made by farms certified under the safety certification program and the cost of those claims to determine whether any statistical correlation of claim reduction exists that could be used to reduce workers’ compensation premiums.

Sec. 2.  21 V.S.A. § 624(m) is added to read:

(m)  The agency of agriculture, food and markets, in collaboration with the University of Vermont extension service, the department of labor, and the department of banking, insurance, securities, and health care administration, shall develop rural and agricultural vocational rehabilitation best management practices for use by vocational rehabilitation counselors.
