Subject:  Health; certificates of need; ambulatory surgical care centers

Statement of purpose:  This bill proposes to require ambulatory surgical care centers to apply for and to receive from the commissioner of BISHCA a certificate of need before development. 

AN ACT RELATING TO CERTIFICATES OF NEED FOR AMBULATORY SURGICAL CARE CENTERS

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  18 V.S.A § 9434(a)(6) is added to read: 

(a)  A health care facility other than a hospital shall not develop, or have

developed on its behalf a new health care project without issuance of a

certificate of need by the commissioner.  For purposes of this subsection, a

“new health care project” includes the following:

(6)  The construction, development, purchase, renovation, or other establishment of any ambulatory surgical center, as defined in subdivision 9432(1) of this title.
