Subject: Professions and occupations; contractors; licensing
Statement of purpose: This bill proposes to increase consumer protection for plumbing and electrical work performed by unlicensed professional contractors by requiring adherence to recognized safety standards.
AN ACT RELATING TO REQUIRING UNLICENSED PROFESSIONAL PLUMBING AND ELECTRICAL CONTRACTORS’ ADHERENCE TO RECOGNIZED SAFETY STANDARDS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 26 V.S.A. § 910(6) is amended to read:
(6) Any electrical work in a building used for dwelling or residential purposes which contains no more than two dwelling units. All work performed under this subdivision shall conform to a nationally recognized electrical code if one is adopted by the board under section 891 of this title.
Sec. 2. 26 V.S.A. § 2173(a) is amended to read:
(a) The plumber's examining board may, pursuant to the provisions of
3 V.S.A. chapter 25 (Administrative Procedure Act), make and
revise such plumbing rules as necessary for protection of the public health. The
rules shall be in effect in every city, village, and town
having a public
water system or public sewerage system and apply to all premises connected to
the systems and all public buildings containing plumbing or water treatment and
heating specialties whether they are connected to a public water or sewerage
system and apply to all structures that contain plumbing or water
treatment and heat specialties. The local board of health and the
commissioner of public safety shall each have authority to enforce these rules.
The rules shall be limited to minimum performance standards reasonably
necessary for the protection of the public against accepted health hazards. The
board may, if it finds it practicable to do so, adopt the provisions of a
nationally recognized plumbing code.
Sec. 3. 26 V.S.A. § 21989(a)(8) is added to read:
(8) Plumbing installed or maintained in a building used for dwelling or residential purposes which contains no more than two dwelling units. All work performed under this subdivision shall conform to a nationally recognized plumbing code if one is adopted by the board under subsection 2173(a) of this title.
Sec. 4. REPEAL
26 V.S.A. § 2198(b) is repealed.
