Subject: Conservation; nuclear facility fence line radiation
Statement of purpose: This bill proposes to require nuclear facilities to meet fence line radiation levels set by the department of health. Failure to do so in a particular month shall be subject to an enforcement action brought by the attorney general, before the environmental court, and may result in the assessment of a penalty that equals 50 percent of the corporate profit at the facility for that month.
AN ACT RELATING TO REQUIRING NUCLEAR FACILITIES TO COMPLY WITH FENCE LINE RADIATION LEVELS ESTABLISHED BY THE DEPARTMENT OF HEALTH
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 10 V.S.A. chapter 157, subchapter 3 is added to read:
Subchapter 3. Compliance with State Law
§ 6531. STATE FENCE LINE RADIATION LEVELS
(a) Any facility shall comply with fence line radiation levels established by the department of health.
(b) For every month that radiation levels at a facility’s fence line exceed the maximum levels established by the department of health, the facility owner will be subject to a fine that will be set at a level that equals 50 percent of the corporate profit at the facility for that month.
(c) Actions to enforce the provisions of this section shall be brought by the attorney general before the environmental court.
