Statement of purpose:  This bill proposes to make it clear that staff of the Vermont state nuclear advisory panel have an affirmative duty to provide information to panel members and to share fully their knowledge relating to subjects within the scope of the panel’s mandate.

AN ACT RELATING TO KEEPING THE VERMONT STATE NUCLEAR ADVISORY PANEL FULLY INFORMED

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  18 V.S.A. § 1702 is amended to read:

§ 1702.  ASSISTANCE

Staff services for the committee panel shall be furnished by the department of public service, the agency of human services, the agency of environmental conservation, and the office of the attorney generalState employees who serve on the panel and those who provide staff services for the panel shall keep the panel reasonably informed about the status of matters within the jurisdiction of the panel and shall promptly comply with reasonable requests from panel members for information.  In addition, these state employees have a duty to share fully with panel members their knowledge in the form of information and advice relating to subjects within the scope of the panel's mandate.  This shall include disclosure to members of the panel of all material facts known to the state employees which will enable the panel to make informed decisions and recommendations, whether or not particular facts are adverse to the policy positions of any particular administration.
