Subject: Human services; Woodside Juvenile Rehabilitation Center; victim of sexual assault
Statement of purpose: This bill proposes to direct the commissioner of the department for children and families to adopt a rule establishing procedures to ensure that a victim of sexual assault who is detained at the Woodside Juvenile Rehabilitation Center is not required to interact with or be in the same room with the perpetrator.
AN ACT RELATING TO SEPARATION OF A VICTIM OF SEXUAL ASSAULT AND THE PERPETRATOR AT THE WOODSIDE JUVENILE REHABILITATION CENTER
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 33 V.S.A. § 5802 is added to read:
§ 5802. SEPARATION OF VICTIM OF SEXUAL ASSAULT AND
The commissioner of the department for children and families shall adopt a rule which shall ensure that a victim of sexual assault is not required to interact with or be in the same room with the perpetrator of the assault. The rule shall ensure that both the victim and the perpetrator continue to receive an appropriate education and may include provisions for alternative educational services for either of them, for receiving educational services in separate classrooms, and for ensuring different times to use facilities such as a cafeteria or recreational facility.
