Subject: Insurance; dispute over coverage; attorney’s fees
Statement of purpose: This bill proposes to award costs and reasonable attorney’s fees to a person who is insured under an insurance contract and who prevails in an action disputing an insurer’s denial of coverage under the contract.
AN ACT RELATING TO AWARDING ATTORNEY’S FEES TO A LITIGANT WHO PREVAILS IN A SUIT DISPUTING AN INSURER’S DENIAL OF COVERAGE
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 8 V.S.A. § 4727 is added to read:
§ 4727. ATTORNEY’S FEES
A person who is insured under an insurance contract and is the prevailing party in an action disputing an insurer’s denial of coverage under the contract shall be awarded costs and reasonable attorney’s fees in addition to any other damages.
