Subject: Municipal and county government; ambulance services; civil action to recover costs
Statement of purpose: This bill proposes to allow an ambulance provider to bring a civil action against a person to recover the costs of providing emergency medical treatment required as a result of that person’s negligent acts.
AN ACT RELATING TO ALLOWING AN AMBULANCE PROVIDER TO BRING A CIVIL ACTION AGAINST A NEGLIGENT PARTY TO RECOVER THE COSTS OF PROVIDING EMERGENCY MEDICAL TREATMENT
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 24 V.S.A. § 2689 is added to read:
§ 2689. CIVIL ACTION TO RECOVER COSTS OF PROVIDING
EMERGENCY MEDICAL TREATMENT
An ambulance provider that provides emergency medical treatment to a person for injuries sustained as a result of the person’s negligent acts shall be entitled to recover the costs of the treatment in a civil action against the person. The action shall be filed in the superior court of the county where the ambulance provider is located or the person resides.
