Statement of purpose: This bill proposes to authorize the commissioner of education to exempt a school district from state education statutes upon approval of the district’s proposal to implement alternative, less costly measures that meet statutory goals.
AN ACT RELATING TO AUTHORIZING ALTERNATIVE,
COST-CONTAINING MEASURES BY SCHOOL DISTRICTS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 16 V.S.A. § 16 is added to read:
§ 16. EXEMPTIONS; ALTERNATIVE, COST-CONTAINING MEASURES
The commissioner of education may exempt a school district from the specific requirements of any section of this title if, in the commissioner’s sole opinion, the district proposes to pursue alternative, less costly measures that meet the specific intent of the section and do not violate any other federal or state law. An exemption shall apply to the sole fiscal year for which it is granted, but may be granted annually upon separate request. The commissioner’s determination shall be final.
