Subject: Crimes; sexual assault; sexual activity between a school employee and a student
Statement of purpose: This bill proposes to criminalize sexual activity between a school employee and a student who has reached the age of consent, punishable by up to 10 years in prison.
AN ACT RELATING TO SEXUAL ACTIVITY BETWEEN A SCHOOL EMPLOYEE AND A STUDENT
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 13 V.S.A. § 3258 is added to read:
3258. SEXUAL ACTIVITY BETWEEN A SCHOOL EMPLOYEE AND A
(a) No person who is an employee in a supervisory union, a school district, or approved or recognized independent school shall engage in a sexual act with a student over the age of consent who is enrolled in or attending a program or school within the person’s supervisory union, school district, or independent school.
(b) For the purposes of this section, the terms “supervisory union,” “school district,” “approved independent school,” and “recognized independent school” are as defined in 16 V.S.A. § 11. The term “employee” shall include volunteers and contractors and their employees who have direct contact with students as a result of their work for the program, school district, or school in which the student victim is enrolled or in attendance.
(c) A person who violates subsection (a) of this section shall be imprisoned not more than 10 years or fined not more than $5,000.00, or both.
