Subject: County government; sheriffs; budget committees
Statement of purpose: This bill proposes to allow for the creation of a sheriff's law enforcement budget committee in each county which may propose a budget for funding employees of a sheriff's office who are engaged in general or specialized law enforcement activities.
AN ACT RELATING TO SHERIFF’S LAW ENFORCEMENT BUDGET COMMITTEES
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 24 V.S.A. § 313 is added to read:
§ 313. SHERIFF’S LAW ENFORCEMENT BUDGET COMMITTEE
(a) The sheriff of each county may form a sheriff’s law enforcement budget committee for which the sole purpose shall be to act on and forward to the assistant judges a budget to supplement county funding for the operation of the sheriff’s office, including funding for its employees, vehicles, equipment, and other necessary items as approved by the budget committee to enable the respective sheriff’s office to engage in general or specialized law enforcement activities. This budget shall be included as a separate line item in the proposed county budget prepared pursuant to section 133 of this title. If a majority of the committee approves the budget and forwards it to the assistant judges, it shall be included as part of the proposed county budget for those towns that elect to be part of the sheriff’s law enforcement budget committee.
(b) A sheriff’s law enforcement budget committee shall consist of the sheriff, the two assistant judges, and one member of the legislative body of each municipality in the county that chooses to participate. A committee shall have no authority over any other areas of the county budget nor shall it have any authority over any other funding or budgets of its sheriff’s office. A committee shall develop policies and procedures regarding the committee’s oversight of the budget approved under this section and which provide the sheriff the ability to operate his or her office within the constraints of the budget.
(c) The assistant judges of a county shall provide the approved compensation for personnel employed by the sheriff who are engaged in general or specialized law enforcement activities only within the limits of the budget presented by a sheriff’s law enforcement budget committee. This compensation shall not duplicate any compensation otherwise provided by law.
(d) This section shall not impede or affect a sheriff’s authority to enter into contracts pursuant to section 290 of this title.
Sec. 2. EFFECTIVE DATE
This act shall take effect upon passage and shall apply in the first full county budget year following passage.
