Subject: Education; education fund; purpose
Statement of purpose: This bill proposes to restrict use of the education fund to those essential elements that provide equal educational opportunity to public school students in kindergarten through grade 12.
AN ACT RELATING TO USING THE EDUCATION FUND SOLELY TO ENSURE EQUAL EDUCATIONAL OPPORTUNITY IN KINDERGARTEN THROUGH GRADE 12
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 16 V.S.A. § 4025(d) is amended to read:
(d)(1) It is the intent of the general assembly that the education fund be used solely to provide the essential elements necessary to ensure equal educational opportunity to all Vermont public school students in kindergarten through grade 12, as those elements are defined by state board rule as necessary to achieve school quality standards. Although many other programs may have merit, programs that are not essential elements of public education in kindergarten through grade 12 shall not be paid for from the education fund, including such programs as adult basic education, the department of corrections’ educational programs, prekindergarten education, and the current use program.
(2) Upon withdrawal of funds from the education fund for any purpose other than those authorized by this section, chapter 135 of Title 32 (education property tax) is repealed.
