Subject: Conservation; Act 250; small homebuilder exemption
Statement of purpose: This bill proposes to exempt from the Act 250 definition of “development” the construction of up to five residential units per year by a person who did not subdivide the land and who is not otherwise subject to Act 250 jurisdiction.
AN ACT RELATING TO A SMALL HOMEBUILDER EXEMPTION FROM ACT 250
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 10 V.S.A. § 6001(3)(D) is amended to read:
(D) The word "development" does not include:
(i) The construction of improvements for farming, logging, or forestry purposes below the elevation of 2,500 feet.
construction of improvements for an electric generation or transmission
facility that requires a certificate of public good under
V.S.A. § 248 or a natural gas facility as defined in subdivision 30 V.S.A.

(vi) The construction of up to five units of housing per calendar year by a person, on land not subdivided by the person, provided that the person is not otherwise subject to the jurisdiction of this chapter.
