Subject: Executive branch; personal services contracts; outsourcing; prohibition
Statement of purpose: This bill proposes to prohibit state agencies from entering into personal services contracts with contractors who perform work at a site outside the United States.
AN ACT RELATING TO PROHIBITING THE OUTSOURCING OF STATE SERVICES
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 3 V.S.A. § 345 is added to read:
§ 345. PERSONAL SERVICES CONTRACTS; OUTSOURCING;
(a) The secretary of administration shall conduct a review of all state contracts valued at over $50,000.00 to determine whether any of the contractors perform work outside the United States. The secretary shall file a report of his or her findings with the general assembly on January 1, 2008 and on January 1 of each year thereafter.
(b) No state agency shall enter into a personal services contract with a contractor who performs the work required by the contract at a site outside the United States. A contractor shall not be deemed to perform work at a site outside the United States solely because the contractor may own foreign investments.
(c) A contractor who submits a bid for a personal services contract shall certify that the services the contractor will provide will be performed in the United States.
