Subject: Fish and wildlife; wholesale bait dealer’s permit; biodegradable containers
Statement of purpose: This bill proposes to require that a person obtain a wholesale bait dealer’s permit before selling prepackaged worms for resale by a commercial bait dealer, and that a fee be charged for the permit if the worms are packaged in nonbiodegradable containers.
AN ACT RELATING TO A WHOLESALE BAIT DEALER’S PERMIT AND A FEE FOR USE OF NONBIODEGRADABLE CONTAINERS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 10 V.S.A. § 4616 is added to read:
§ 4616. WHOLESALE BAIT DEALER’S PERMIT
(a) No person shall sell or offer to sell prepackaged worms for use as bait to anyone requiring a commercial bait dealer’s permit without first obtaining a wholesale bait dealer’s permit from the commissioner. The commissioner shall describe the application process by rule.
(b) The commissioner may establish a fee necessary to cover the cost of processing the wholesale bait dealer’s permit and may require this fee of the applicant.
(c) No person obtaining a permit under this section may package the worms for sale in a nonbiodegradable container without paying to the commissioner a fee of $500.00 in addition to any fee charged under subsection (b) of this section.
