Subject: Water resources; wetlands; mitigation
Statement of purpose: This bill proposes to require the water resources panel to adopt rules for the replacement or mitigation of significant wetlands. The rules shall include wetlands mitigation banking and payment in lieu of mitigation programs.
AN ACT RELATING TO WETLANDS MITIGATION BANKING
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 10 V.S.A. § 6025(f) is added to read:
(f) Prior to or concurrently with adoption of any rules amending the jurisdiction over and regulatory scheme for wetlands in Vermont, the water resources panel shall adopt rules for the replacement or mitigation of significant wetlands. The rules shall include wetlands mitigation banking and payment in lieu of mitigation programs. The rules for wetland mitigation banking may address private or public wetlands mitigation banking.
Sec. 2. WATER RESOURCES PANEL; WETLANDS REPLACEMENT
On or before January 15, 2008, the water resources panel shall report to the house committee on fish, wildlife and water resources, the senate committee on natural resources and energy, and the house and senate committees on agriculture regarding the feasibility of implementing wetlands replacement rules in the state. The report shall include an analysis of the benefits and obstacles to establishing and overseeing private and public mitigation banks in Vermont and to establishing other payment in lieu of mitigation programs.
Sec. 3. EFFECTIVE DATE
(a) This section and Sec. 2 (water resources panel wetlands replacement report) shall take effect on July 1, 2007.
(b) Sec. 1 (wetlands replacement or mitigation rules) shall take effect
July 1, 2008.
