Statement of purpose:  This bill proposes to permit the court to award primary, sole, or shared parental rights and responsibilities based only upon the best interests of the child, eliminating the current requirement that the court award primary or sole responsibilities to one parent if the parents cannot agree to shared custody.

AN ACT RELATING TO PARENTAL RIGHTS AND RESPONSIBILITIES

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  15 V.S.A. § 665(a) is amended to read:

§ 665.  RIGHTS AND RESPONSIBILITIES ORDER; BEST INTERESTS OF

            THE CHILD

(a)  In an action under this chapter, the court shall make an order concerning parental rights and responsibilities of any minor child of the parties.  The court may order parental rights and responsibilities to be divided or shared between the parents on such terms and conditions as serve the best interests of the child.  When the parents cannot agree to divide or share parental rights and responsibilities, the court shall award parental rights and responsibilities primarily or solely to one parent The court shall order parental rights and responsibilities to be shared or to be awarded primarily or solely to one parent based upon the best interests of the child.
