Statement of purpose:  This bill proposes to amend the prohibition on the sale of mercury-added products to apply to products manufactured on or after

July 1, 2007.

AN ACT RELATING TO THE SALE OF MERCURY-ADDED PRODUCTS

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  10 V.S.A. § 7106 is amended to read:

§ 7106.  LABELING OF MERCURY-ADDED PRODUCTS

(a)  No mercury-added product manufactured on or after July 1, 2007 may be offered for final sale, sold at a final sale, or distributed in Vermont after July 1, 2007, unless both the product and its packaging are labeled in accordance with this section.  This requirement also may be met by compliance with the terms of any approved alternative labeling method granted under subsection


(h) or (i) of this section.  A retailer may not be found in violation of this subsection if the retailer lacked knowledge that the product contained mercury.
