Subject:  Municipal government; zoning enforcement

Statement of purpose:  This bill proposes to allow a municipality to bring actions for zoning violations as it does for violations of civil ordinances, but without adopting the underlying zoning bylaws as ordinances.

AN ACT RELATING TO ENFORCEMENT ACTIONS FOR ZONING VIOLATIONS

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  24 V.S.A. § 1974a is amended to read:

§ 1974a.  ENFORCEMENT OF ACTIONS FOR CIVIL ORDINANCE VIOLATIONS

(d)  Civil A civil enforcement of action for a municipal zoning violations   violation may be brought as an enforcement action for a civil ordinance violation pursuant to this section or in as an enforcement action pursuant to the requirements of chapter 117 of this title.  In order to enforce under this chapter against zoning violations, a municipality is not required to adopt the underlying zoning bylaws as ordinances under this chapter.
