AN ACT RELATING TO THE TRANSFER OF PAYROLL FUNCTIONS FROM THE DEPARTMENT OF HUMAN RESOURCES TO THE DEPARTMENT OF FINANCE AND MANAGEMENT

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  3 V.S.A. § 2281 is amended to read:

§ 2281.  DEPARTMENT OF FINANCE AND MANAGEMENT

The department of finance and management is created in the agency of administration and is charged with all powers and duties assigned to it by law, including the following:

(1)  to administer the financial transactions of the state, including payroll transactions, in accordance with the law and within the limits of appropriations made by the general assembly;

(2)  to conduct management studies and audits of the performance of state government;

(3)  to prepare the executive budget;

(4)  to report on an annual basis to the joint fiscal committee at its November meetings on the allocation of funds contained in the annual pay acts and the allocation of funds in the annual appropriations act which relate to those annual pay acts.  The report shall include the formula for computing these funds, the basis for the formula, and the distribution of the different funding sources among state agencies. The report shall also be submitted to the members of the house and senate committees on government operations and appropriations; and

(5)  at the time the department files its annual accounting report under section 182 of Title 32, to report on the number of special funds and balance of each special fund within each agency, department, commission, or other state governmental entity; and

(6)  to maintain a central payroll office which shall be the successor to and continuation of the payroll functions of the department of human resources.

Sec. 2.  3 V.S.A. § 2283 is amended to read:

§ 2283.  DEPARTMENT OF HUMAN RESOURCES

(a)  The department of human resources is created in the agency of administration. In addition to other responsibilities assigned to it by law, the department is responsible for fulfilling the payroll functions and for the provision of centralized human resources management services for state government, including the administration of a classification and compensation system for state employees under chapter 13 of this title and the performance of duties assigned to the commissioner of human resources under chapter 27 of this title.

(b)  The department of human resources shall maintain a central payroll office, which shall be the successor to and continuation of the payroll division of the department of finance and management.

Sec. 3.  32 V.S.A. § 182(a)(6) is amended to read:

(6)  Draw warrants on the treasurer for all valid and legal payroll disbursements certified, by voucher, by the commissioner of human resources;

Sec. 4.  32 V.S.A. § 463 is amended to read:

§ 463.  ITEMIZED BILLS WITH VOUCHERS REQUIRED

The commissioner of finance and management and the commissioner of human resources shall require all bills presented to them him or her for allowance to be fully itemized and accompanied, as far as possible, with vouchers. 

Sec. 5.  32 V.S.A. § 464 is amended to read:

§ 464.  ITEMIZED STATEMENTS AND RECEIPTS REQUIRED

When required by the commissioner of finance and management and before payment therefor is made by the state, all claimants for compensation for services rendered or expense incurred for the state shall furnish the commissioner of finance and management itemized statements in such form as the commissioner of finance and management may from time to time prescribe and shall be verified by written declarations that they are made under the pains and penalties of perjury, and a person who wilfully makes a false statement shall be guilty of perjury and be punished accordingly.  However, the commissioner of human resources shall exercise such authority as is necessary to carry out the payroll function. 

Sec. 6.  TRANSFER OF RULES, POSITIONS, AND APPROPRIATIONS

(a)  The rules of the department of human resources relating to payroll functions in effect on the effective date of this act shall be the rules of the department of finance and management until amended or repealed by that department.  All references in those rules to the “commissioner” and the “department of human resources” shall be deemed to refer to the “commissioner of finance and management” and the “department of finance and management” respectively.

(b)  All employees, professional and support staff, consultants, positions, and equipment and the remaining balances of all appropriations for personal services and operating expenses for payroll functions are transferred from the department of human resources to the department of finance and management.

Sec. 7.  STATUTORY REVISION

The legislative council is directed to substitute the term “commissioner of human resources” with the term “commissioner of finance and management” in: 2 V.S.A. § 406(b)(2); 3 V.S.A. § 631(a)(6) and (7); 24 V.S.A. § 364(a); and 32 V.S.A. §§ 1183(b) and 1261(a).


Sec. 8.  REPEAL

3 V.S.A. § 309(a)(16), (17), and (18) (duties of commissioner of human resources relating to payroll functions) are repealed.
