ACT NO. 195
Boating while intoxicated; driving under the influence
This amends several motor vehicle offenses to permit the state to charge the offender with a separate violation for each person who is injured or killed as a result of the offense. The change applies to the following offenses: operating a motor vehicle under the influence of alcohol, boating while intoxicated, attempting to elude a police officer, and grossly negligent operation of a motor vehicle. The act also repeals the provision that made law enforcement training standards optional for elected officials. Finally, the act requires scrap metal processors who purchase scrap metal from unauthorized scrap sellers to record the sellers name, address, date of birth, and a record of the transaction in a permanent ledger for at least five years. The act establishes fines for scrap metal processors who do not comply with these requirements.
Effective Date: July 1, 2008.
