ACT NO. 194
Communicable diseases; health care workers; testing
This act allows first responders and other emergency personnel to request their patient be tested for bloodborne pathogens, provided the first responder has been exposed to the blood or bodily fluids of the source patient in a manner sufficient to transmit a bloodborne pathogen-related illness to the affected first responder while he or she is engaged in rendering health services to the source patient. Such tests, however, may only be obtained if the source patient has provided informed consent or is deceased. In addition, the act contains numerous other safeguards related to ensuring the confidentiality of test results.
Effective Date: June 9, 2008.
