Vermont Yankee nuclear facility; reliability assessment

This act provides for a comprehensive independent and public assessment of the reliability of the systems, structures, and components of the Entergy Nuclear Vermont Yankee facility in order to inform the general assembly in making its determination whether the facility may operate in the state beyond the expiration of its current operating license on March 21, 2012.

The act requires a physical and documentation examination of at least seven whole plant systems identified in the act, outlines specific audit inquiries to be addressed with respect to each system, and directs that a vertical/horizontal inspection methodology and work plan be employed in the assessment.

The comprehensive reliability assessment is to be conducted by an audit inspection team of independent consultants, experts, and technicians selected by the department of public service who have not been employed or retained by the Vermont Yankee facility or Entergy Nuclear or its affiliates in the prior three years.

A public oversight panel is created to consist of three to five members with expertise in nuclear technology or nuclear regulation. The speaker of the house, the president pro tempore of the senate and the governor shall each appoint one member of the panel. Those three members may select one or two additional members of the panel.

The public oversight panel is directed to oversee the conduct of the comprehensive reliability assessment and to consult with the department on the selection of the audit inspection team and on the time-frame, work plan, and methodology of the assessment. The public oversight panel is provided access to all documents and records generated in the reliability assessment as well as to any records and documents generated by any other audit or assessment of the Yankee facility pertinent to the assessment. No later than January 30, 2009, the public oversight panel shall report to the general assembly its findings and evaluation of the comprehensive reliability assessment.

The expenses and costs of the comprehensive reliability assessment, the audit inspection team, and the public oversight panel are to be charged to the petitioner for a license expansion under existing public service bill-back provisions of Title 30.
