Storage unit facilities; lien
This act creates a possessory lien upon personal property stored at a self-storage facility for rent, labor, or other charges related to a rental agreement and for expenses incurred by the owner of the facility relevant to preserving or disposing of such property following a default under a rental agreement.
The act requires the owner of the facility to disclose the existence of the lien to the occupant in a rental agreement, sets out a series of steps required to enforce the lien including notice and advertisement of sale, requires the sale of property to satisfy the lien to be performed in a commercially reasonable manner, and affords a right of repossession by the holders of other registered liens on the property stored in the unit.
Effective Date: January 1, 2009.
