Conveyance of real estate; homestead; discharge of

a mortgage by an attorney

This act allows a spouse or civil union partner to convey during life his or her homestead interest to the other spouse or civil union partner. The act validates mortgage discharges and instruments conveying real property which contain certain technical errors as long as no suit is brought challenging t he validity of the discharge or instrument within three years after it is recorded. The act permits an attorney licensed in Vermont to discharge a recorded mortgage if due to certain technical errors the mortgage was not properly executed or recorded.

Effective Date: July 1, 2008.
