Larceny and embezzlement; person holding property
in official capacity or belonging to state or municipality
This act amends the statute relating to embezzlement by a public official in two ways: First, it clarifies that a public official commits embezzlement when he or she embezzles money, obligations, securities, or other property regardless of its source. The prior law specified that the funds must belong to a public or private corporation or to a private person. Second, the act makes it a crime for a person to embezzle money or other property belonging to a county, municipality, or special purpose district. Prior law only reached property belonging to the state or a municipal corporation.
The act also allows a court at arraignment to suspend the duties of a state, county, or municipal officer who is charged with embezzlement by a public official as a condition of the officers release.
Effective Date: July 1, 2008.
