Electronic access to criminal and family court records
This act permits the Vermont criminal information center to provide the general public with electronic access to criminal conviction records. Access to the records may only be permitted through a secure Internet site or another alternative approved by the center. A person who requests a record must establish a secure, online account with the center and sign a user agreement prohibiting the alteration of criminal records and requiring the requestor to comply with all statutes, rules, and policies regulating the release of criminal conviction records and the protection of individual privacy. All requests must include the name and date of birth of the subject. Only no record responses and record responses which constitute an exact match to the query criteria may be returned automatically online. In the event that query criteria suggest a possible match, the center will determine whether the query criteria match a record in the repository and return the result to the requestor. A $20.00 fee is charged for each request; the fee increases to $30.00 on July 1, 2009.
The act also prohibits the court from permitting public access via the Internet to criminal case records or family court case records.
Effective Date: July 1, 2008, except for the provision raising the fee to $30.00, which takes effect on July 1, 2009.
