Public water systems; consecutive water systems

This act exempts from the state public water supply requirements certain public water systems that receive water from another public water system. A receiving public water system is exempt from all public water supply requirements, except construction permitting, if it consists only of distribution and storage facilities, does not have collection and treatment facilities, does not engage in the sale of water, is not a carrier of passengers in interstate commerce, serves fewer than 500 person, and obtains all of its water from a permitted public water system that meets all of the public water supply requirements. A public water system supplying water to a receiving water system must also certify that it is responsible for including the receiving water system in its water quality sampling plans and for providing consumer confidence reports to customers of the receiving system. The act also clarifies that a receiving water system that qualifies for the exemption from the public water supply requirements is not subject to regulation by the public service board as a company engaged in the sale of water.

Effective Date: July 1, 2008.
