Museum property

This act provides that any property held by a museum that is not subject to a loan agreement, has been held for 10 or more years, and has remained unclaimed shall be deemed to be abandoned. The property shall become property of the museum, provided that museum has given notice as required in the act, and no assertion of title has been filed within 180 days from the date of the third published notice. Notice required by the act includes certified mail to the last known owner at the most recent address, followed by publication for three successive months in the county of the last known address of the owner and in the county in which the museum is located. The act has exemptions for stolen property and certain other property that has been seized. The act also enables a museum to terminate a loan for an indefinite term, if the property has been held by the museum for 10 years or more, by following the notice process established in the act.

Effective Date: July 1, 2008.
