ACT NO. 110
This act amends the definition of public record and clarifies the appeal process when a public agency denies access to a public record. The definition of public record is amended to mean any written or recorded information, regardless of physical form or characteristics, which is produced or acquired in the course of agency business. When a public agency denies access to a public record, the denial may be appealed to the head of the agency. The head of the agency shall make a written determination on an appeal within five business days and shall provide, in writing, the asserted statutory basis for
denial. In addition, beginning January 1, 2010, the act requires all vital records issued in the state to be issued on antifraud paper.
Effective Date: July 1, 2008.
