Prescription drugs

This act delays until July 1, 2009 implementation of the provisions of No. 80 of the Acts of the 2007 session relating to confidentiality of prescription information and certain consumer protections.  It clarifies the use of records containing prescriber-identifiable information with the prescriber’s consent and eliminates certain disclosure requirements.  It includes in the definition of a “regulated record” only those prescriptions dispensed in Vermont and written by a prescriber doing business in Vermont.  It also deletes provisions of Act 80 that make a warning or untitled letter from the U.S. Food and Drug Administration prima facie evidence of a violation of federal law and regulations and extends for one year the deadline for a report on the generic drug voucher pilot program.

Effective Date: Upon passage.
