NO. 45. AN ACT RELATING TO PAY SCALE, DEATH BENEFIT, AND TUITION BENEFITS FOR MEMBERS OF THE NATIONAL GUARD.
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 20 V.S.A. § 603 is amended to read:
§ 603. ARMS AND EQUIPMENT; PAY AND RATIONS
the national guard, or part thereof, is ordered out under the provisions of
sections 366, 601, or 602 of this title, the state shall furnish
arms and equipments as are equipment necessary for each officer,
warrant officer, and enlisted man person; and they shall
be entitled to the same pay and rations as the army of the United
States, and shall be paid under such regulations as the commander in chief
prescribes, provided, however, that no member shall be paid less than $28.00
per day equivalent to that paid to members of the armed forces of the
United States for officers, warrant officers, and enlisted persons of
corresponding grade and time in service as designated in the U.S. pay tables.
Sec. 2. 20 V.S.A. § 607 is added to read:
§ 607. STATE ACTIVE DUTY DEATH BENEFIT
There is established a death benefit in the amount of $50,000.00 for each activated Vermont national guard member who dies while on state active duty or as the result of injuries incurred while on state active duty, provided the
death or the injuries that result in death resulted from performing state active duty or from engaging in conduct related to state active duty.
