Conservation; underground and above ground storage tanks;
petroleum cleanup fund
This act amends provisions of the state petroleum cleanup fund (PCF), amends current requirements for underground storage tanks (USTs), and establishes new requirements for above ground storage tanks (ASTs). The act prohibits delivery of chemicals or petroleum to category 1 USTs that fail to meet state standards. The secretary of natural resources would be required to adopt by rule state standards for the design and proper installation of ASTs.
The act authorizes the secretary of natural resources to transfer up to $250,000.00 each year between the motor fuel and heating fuel accounts of the PCF. The act also authorizes owners of a UST or AST used to heat a mobile home to apply for grant assistance from the PCF. The maximum amount of loans from the UST loan assistance program increases to $75,000.00, and the act specifies from which PCF account loans would be provided. A person owning five or more facilities with a UST or AST would be required to pay an interest rate of 4 percent for a loan from the PCF instead of the normal zero interest loan. In addition, the sunset date for fees assessed against retail sellers of heating oil or kerosene is extended to 2011.
