Statement of purpose:  This bill proposes to create a nursing home reimbursement system which ensures sufficient compensation for nursing homes, considering the demographics and population of the location and to create incentives for nursing homes to achieve the appropriate mixture of home- and community‑based services and nursing home services.

AN ACT RELATING TO NURSING HOME REIMBURSEMENT FROM MEDICAID

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  MEDICAID NURSING HOME RATES

The agency of human services shall amend the rules for establishing Medicaid payment rates for long-term care facilities by eliminating the requirement for minimum occupancy levels for the nursing care costs.

Sec. 2.  TASK FORCE ON MEDICAID REIMBURSEMENT RATES IN

             NURSING HOMES

The commissioner of disabilities, aging, and independent living shall convene a task force to analyze Medicaid reimbursement rates for nursing homes.  The task force shall include three representatives of the Vermont health care association, one each representing for-profit, not-for-profit, and independently-owned facilities, and the director of the division of rate setting in the agency of human services.  The task force and the task force on the future sustainability of nursing homes shall coordinate as necessary.  The task force shall make recommendations on changes to the rules, methods, standards, and principles for establishing Medicaid payment rates for long-term care facilities in order to meet the protocols and objectives of the choices for care Section 1115 Medicaid waiver to the general assembly by January 15, 2007.

Sec. 3.  EFFECTIVE DATE

This act shall be effective immediately upon passage.
