Statement of purpose: This bill proposes to require insurance plans that cover acupuncture to cover that service without regard to the type of health care provider providing the acupuncture service.
AN ACT RELATING TO INSURANCE COVERAGE OF ACUPUNCTURE
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 8 V.S.A. § 4089k is added to read:
§ 4089k. ACUPUNCTURE
(a) As used in this section:
(1) “Health care provider” has the same meaning as in section 9402 of Title 18.
(2) “Health insurance plan” means an individual or group health insurance policy, hospital or medical service corporation service contract, or health maintenance organization health benefit plan offered, issued, or renewed in this state.
(b) If a health insurance plan provides coverage for acupuncture treatment, it shall cover acupuncture treatment by any type of health care provider acting within the scope of practice authorized. A health insurance plan shall not be required to provide coverage for acupuncture treatment. A health insurance plan shall not establish any rate, term, or condition that places a greater financial burden on an insured person for access to acupuncture treatment by any particular type of health care provider than for access to acupuncture treatment by any other type of health care provider.
