Subject:  Public service; certificate of public good; economic effects

Statement of purpose:  This bill proposes to make it clear that during the review process for the issuance of a certificate of public good for a new electricity generating facility, when the public service board is required to find that there is an “economic benefit” to be expected from the proposal, the board must consider all economic factors involved, including the negative economic effects of adverse environmental effects.

AN ACT RELATING TO THE CONSIDERATION OF ECONOMIC BENEFIT DURING A PUBLIC SERVICE BOARD PROCEEDING RELATING TO A CERTIFICATE OF PUBLIC GOOD

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  30 V.S.A. § 248(b) is amended to read:

(b)  Before the public service board issues a certificate of public good as required under subsection (a) of this section, it shall find that the purchase, investment, or construction:

(4)  will result in an a net economic benefit to the state and its residents, a determination that shall be reached only after considering all economic factors involved, including the negative economic value of any adverse environmental effects;
