Statement of purpose: This bill proposes to require health insurance coverage for covered services regardless of the type of provider.
AN ACT RELATING TO INSURANCE COVERAGE FOR TREATMENT BY ANY AUTHORIZED HEALTH CARE PROVIDER
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 8 V.S.A. § 4089k is added to read:
§ 4089k. HEALTH CARE PROVIDERS
(a) As used in this section:
(1) “Health care provider” has the same meaning as in section 9402 of Title 18.
(2) “Health insurance plan” means an individual or group health insurance policy, hospital or medical service corporation service contract, or health maintenance organization health benefit plan offered, issued, or renewed in this state.
(b) If a health insurance plan provides coverage for a particular type of treatment, it shall cover that treatment when provided by any type of health care provider acting within the scope of practice authorized. This section does not require a health insurance plan to provide coverage for any particular type of treatment. A health insurance plan shall not establish any rate, term, or condition that places on an insured person a greater financial burden for access to treatment by any particular type of health care provider than for access to that same treatment by any other type of health care provider.
