Subject: Fees; fire prevention; municipal buildings; all-terrain vehicles
Statement of purpose: This bill proposes to waive remaining agency of natural resources fees for the construction of municipal fire and safety buildings. It also proposes to waive fire prevention fees for these projects. Finally, it proposes to charge a $10.00 registration fee for an all-terrain vehicle that is owned by a firefighting or rescue organization and used only for firefighting or rescue purposes.
AN ACT RELATING TO REDUCING CERTAIN FEES FOR CONSTRUCTION OF MUNICIPAL FIRE AND SAFETY BUILDINGS AND FOR REGISTRATION OF ALL-TERRAIN VEHICLES USED EXCLUSIVELY FOR FIREFIGHTING AND RESCUE PURPOSES
It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. 3 V.S.A. § 2822(i) is amended to read:
secretary shall not process an application for which the applicable fee has not
been paid unless the secretary specifies that the fee may be paid at a
different time or unless the person applying for the permit is exempt from the
permit fee requirements pursuant to section 710 of Title 32. In addition, the
persons who are exempt under section 710 of Title 32 are also exempt from the
application fees for stormwater operating permits specified in subdivisions
(j)(2)(A)(iii)(I) and (II) of this section if they otherwise meet the
requirements of section 710.
Municipalities Municipal fire and
safety buildings shall be exempt from the payment of fees under this section,
and other municipal projects shall be exempt from the payment of fees under
this section except for those fees prescribed in subdivisions (j)(1), (2), (7),
(8), (14), and (15) of this section for which a municipality may recover its
costs by charging a user fee to those who use the permitted services.

Sec. 2. 20 V.S.A. § 2731(j) is added to read:
(j) Fees under this chapter shall not be assessed for municipal fire and safety building projects.
Sec. 3. 23 V.S.A. § 3504 is amended to read:
§ 3504. REGISTRATION FEES AND PLATES
registration fee for all-terrain vehicles other than as provided for in
(b) subsections (b) and (c) of this section is $35.00. Duplicate
registration certificates may be obtained upon payment of $5.00 to the

(c) The registration fee for registration of an all-terrain vehicle, owned by a volunteer fire department or other volunteer firefighting organization or other organization conducting rescue operations and used solely for firefighting or rescue purposes, shall be $10.00 in lieu of fees otherwise specified in this chapter. An all-terrain vehicle registered under this section shall be plainly marked on both sides of the body or cab to indicate its ownership.
