Subject:  Crimes; false reports to law enforcement officers

Statement of purpose:  This bill proposes to enhance the penalties for making false reports to law enforcement officers and to make the offense applicable when a person provides false information to deflect an investigation from the person or another person.

AN ACT RELATING TO FALSE REPORTS TO LAW ENFORCEMENT OFFICERS

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  13 V.S.A. § 1754 is amended to read:

§ 1754.  FALSE REPORTS TO LAW ENFORCEMENT AUTHORITIES

(a)  A person who knowingly gives false information to any law enforcement officer with purpose to implicate another or to deflect an investigation from the person or another person shall be imprisoned for not more than one year two years or fined not more than $1,000.00 $5,000.00, or both.

(b)  A person shall be imprisoned for not more than six months one year or fined not more than $500.00 $1,000.00, or both if he the person:

(1)  Reports to law enforcement authorities an offense or other incident within their concern knowing that it did not occur; or

(2)  Pretends to furnish such authorities with information relating to an offense or incident when he the person knows he the person has no information relating to such offense or incident.
