Subject: Human services; judicial proceedings; transfer from other courts
Statement of purpose: This bill proposes to prohibit the transfer of certain criminal charges to juvenile court if the defendant was a juvenile at the time of the commission of the offense, but is 18 years or older at the time the charge is filed.
AN ACT RELATING TO CHARGING A PERSON IN DISTRICT COURT FOR AN OFFENSE COMMITTED WHEN THE PERSON WAS A JUVENILE
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 33 V.S.A. § 5505(g) is added to read:
(g) If a defendant who is 18 years or older when he or she is charged with a listed crime as defined in 13 V.S.A. § 5301 and if the offense was allegedly committed when the defendant was under the age of 18, the charge shall be brought in district court and may not be transferred to juvenile court.
