Subject: Education; regional technical center school districts; funding
Statement of purpose: This bill proposes to stipulate that a regional technical center school district will adopt its budget by vote of the electorate; and to stipulate that each member district’s share of the budget will become a legal obligation of the district without further vote in the member district.
AN ACT RELATING TO FUNDING OF REGIONAL TECHNICAL CENTER SCHOOL DISTRICTS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 16 V.S.A. § 1578a is added to read:
§ 1578a. ESTABLISHMENT OF A REGIONAL TECHNICAL CENTER
(a) The board of directors of the regional technical center district shall at each annual meeting present an estimate of the expenses for the ensuing year, and the district shall appropriate that sum which it deems necessary for the expenses, together with the amount required to pay any balance left unpaid from the preceding year, expressing the sum in dollars in its vote. If a budget for the operation of the district is not approved, a subsequent meeting or meetings shall be warned.
(b) If a budget has not been approved on or before June 30 of any year, the school board may borrow funds pursuant to the authority granted under section 566 of this title.
(c) Following adoption of a budget, the board shall calculate each member district’s share pursuant to section 1552 of this title. Upon receipt of the notice of the amount, the share shall become a legal obligation of the member district without need for further vote of the member district electorate and shall be included in the member district’s education spending amount.
Sec. 2. REPEAL
The following sections in Title 16 are repealed:
(1) § 1572(b)(2), relating to options for voting of an annual regional technical center budget.
(2) § 1577(10), relating to the budget adoption process in a regional technical center district.
Sec. 3. EFFECTIVE DATE
This act shall take effect for fiscal year 2008.
