Subject:  Campaign finance; expenditures; exemption

Statement of purpose:  This bill proposes to provide an exemption from the campaign finance expenditure limits for the cost of responding to a negative campaign attack.

AN ACT RELATING TO CAMPAIGN FINANCE EXPENDITURE LIMIT EXEMPTION

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  17 V.S.A. § 2801(3) is amended to read:

(3)  “Expenditure” means a payment, disbursement, distribution, advance, deposit, loan, or gift of money or anything of value, paid or promised to be paid, for the purpose of influencing an election, advocating a position on a public question, or supporting or opposing one or more candidates.  “Expenditure” does not mean a payment, disbursement, distribution, advance, deposit, loan, or gift of money or anything of value, paid or promised to be paid, for responding to any electioneering communication that uses a candidate’s name without that candidate’s written permission.
