Subject: Conservation; solid waste; time for approving solid waste plans
Statement of purpose: This bill proposes to require the agency of natural resources to review and approve or deny approval to a solid waste management plan submitted by a solid waste management district, regional planning commission, or municipality within 90 days of receipt of the plan. If the agency fails to act within this period of time, the plan will be deemed to be approved by default. Approval by default does not allow a planning entity to disregard the statutes and the rules regarding the management of solid waste.
AN ACT RELATING TO THE TIME WITHIN WHICH THE AGENCY OF NATURAL RESOURCES MUST REVIEW A SOLID WASTE MANAGEMENT PLAN
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 24 V.S.A. § 2202a(d) is added to read:
(d) In case of any review or approval by the agency of natural resources regarding whether a plan adopted under this section is in conformance with the state solid waste management plan, the agency shall make that determination within 90 days of the receipt of the plan submitted under this section. If the agency fails to make that determination within that period, the plan shall be deemed to be approved by default. Approval of a plan by default, however, shall not release the planning entity, or its population, from having to comply with the requirements of 10 V.S.A. chapter 159 and the rules adopted under that chapter, nor does it release either from having to comply with the provisions of this chapter.
