Subject:  Crimes; sexual assault

Statement of purpose:  This bill proposes to criminalize sexual activity between a school employee and a student who is over the age of consent.  The offense would be a felony punishable by up to 20 years in prison or a fine of up to $10,000.00, or both.

AN ACT RELATING TO SEXUAL ACTIVITY BETWEEN A SCHOOL EMPLOYEE AND A STUDENT

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  13 V.S.A. § 3252(c) is added to read:

(c)  A person who is an employee in a supervisory union, a school district, or an approved or recognized independent school and who engages in a sexual act with a student over the age of consent who is enrolled in or attending a program or school within the actor’s supervisory union, school district, or independent school shall be imprisoned for not more than 20 years or fined not more than $10,000.00, or both.  For the purposes of this subsection, the terms “supervisory union” and “school district” shall have the meanings set forth in section 11 of Title 16 and “approved independent school” and “recognized  independent school” shall have the meanings set forth in section 166 of Title 16.  The term “employee” shall include volunteers and contractors and their employees who have direct contact with students as a result of their work for the program, school district, or school in which the student victim is enrolled or attending.
