Subject:  Education; taxation; school budget vote; appeal; calculation of homestead tax rate

Statement of purpose:  This bill proposes to shorten the period allowed for a second or subsequent revote of a school district budget from 30 to 15 days and to direct the commissioner of taxes to calculate a homestead education tax rate before passage of the 15 days.

AN ACT RELATING TO REVOTING OF A SCHOOL DISTRICT BUDGET AND CALCULATION OF A HOMESTEAD EDUCATION TAX RATE

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  16 V.S.A. § 428(c) is added to read:

(c)  Notwithstanding the provisions of 17 V.S.A. § 2662(b) requiring a revote of a question considered at a municipal meeting if a petition signed by not less than five percent of the voters is filed with the clerk within 30 days following the date of that meeting, in the case of a budget voted under this section which has already been voted on two or more times, the question shall be reconsidered only if a petition is filed within 15 days following the date of the most recent vote.

Sec. 2.  16 V.S.A. § 511(c) is added to read:

(c)  Notwithstanding the provisions of 17 V.S.A. § 2662(b) requiring a revote of a question considered at a municipal meeting if a petition signed by not less than five percent of the voters is filed with the clerk within 30 days following the date of that meeting, in the case of a budget voted under this section which has already been voted on two or more times, the question shall be reconsidered only if a petition is filed within 15 days following the date of the most recent vote.

Sec. 3.  32 V.S.A. § 5402(f) is added to read:

(f)  Following a school district budget vote, the commissioner shall calculate a homestead education tax rate for a municipality by June 1 or within 10 days of a first school district budget vote or first revote of a school district budget for the next fiscal year, whichever is later.  If a school district has voted two or more times on a budget and a subsequent vote occurs after May 17, the commissioner shall not wait for the period for petition for a revote pursuant to subsections 428(c) and 511(c) of Title 16 to pass.  In this case, the commissioner shall calculate a homestead education tax rate using the budget most recently passed and send it to the municipality with a statement that the rate will change if a revote results in a different budget amount.
