Subject: Corrections; good time
Statement of purpose: This bill proposes to amend an anomaly created by No. 63 of the Acts of 2005 regarding the prospective award of good time to inmates and to correct a cross-reference made moot by that act.
AN ACT RELATING TO GOOD TIME
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. PROSPECTIVE AWARD OF GOOD TIME
Notwithstanding any provision of law to the contrary, each individual convicted of a crime committed on or before June 30, 2005 who was on conditional reentry or supervised community service on or after that date shall be entitled to the prospective award of good time pursuant to Sec. 2(b) of No. 63 of the Acts of 2005.
Sec. 2. 28 V.S.A. § 726 is amended to read:
§ 726. REDUCTION OF SENTENCE
day an offender is supervised in a conditional reentry program shall be counted
as one day served for the total effective sentence.
The minimum and maximum
terms of the offender's total effective sentence shall not be subject to any
reductions for behavior as provided for in section 811 of this title.
