Subject: Public service; certificate of public good; wind turbine
Statement of purpose: This bill proposes to require the public service board to act within eight and one-half months on an application for a certificate of public good to construct a wind turbine.
AN ACT RELATING TO REQUIRING THE PUBLIC SERVICE BOARD TO ACT WITHIN EIGHT AND ONE-HALF MONTHS ON ANY APPLICATION FOR A CERTIFICATE OF PUBLIC GOOD TO BUILD A WIND TURBINE
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 30 V.S.A. § 248(m) is added to read:
(m) In the case of an application under this section solely for a certificate of public good to build a wind turbine, the board shall act on the application within a period of eight and one-half months from the date that the complete application for the certificate has been filed. If the board fails to make its determination within the time period set by this subsection, the certificate shall be deemed to be granted.
