Subject: Court procedure; judicial oaths
Statement of purpose: This bill proposes to require a judge or justice to take his or her oath of office on or before April 1 in the year of his or her retention or within ten days after the retention vote of the joint assembly, whichever is later.
AN ACT RELATING TO JUDICIAL OATHS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 12 V.S.A. § 5856 is amended to read:
(a) A judge or justice shall take and subscribe his or her oath or affirmation of allegiance to this state on or before April 1 in the year of his or her retention or within ten days after the vote of the joint assembly under subsection 608(g) of Title 4, whichever is later.
(b) The Vermont supreme court shall adopt a rule which establishes a procedure for the storage of judicial oaths.
Sec. 2. APPLICABILITY
Sec. 1 of this act shall apply to any judge or justice who begins a term of office on or after April 1, 2005, except that a judge or justice who begins a term of office on April 1, 2005 shall take and subscribe his or her oath of office within ten days after this act’s passage.
Sec. 3. EFFECTIVE DATE
This act shall take effect upon passage.
