Subject: Conservation and development; waste management; redevelopment of contaminated properties
Statement of purpose: This bill proposes to enact a uniform law drafted by the National Conference of Commissioners on Uniform State Laws (NCCUSL) to provide the legal infrastructure for creating and enforcing environmental covenants helping to clean up brownfields for redevelopment. The bill would ensure that land use restrictions, mandated environmental monitoring requirements, and a wide range of common engineering controls designed to control the potential risk of contamination will be reflected in the land records and effectively enforced over time as a valid real property servitude. The bill will encourage transfer of ownership and property reuse by offering a clear and objective process for creating, modifying, or terminating environmental covenants and for recording those actions in recorded instruments which will be reflected in the title abstract of the property in question.
